South Dakota GOP members even attempted to make it legal to murder doctors who provide abortion care.

Republican senators also nearly derailed the reauthorization of the Violence Against Women Act.

Life now starts earlier in Arizona: In practice, the state has banned abortions after about 18 weeks.

Despite its name, critics derided the Women’s Health and Safety Act that Arizona Governor Jan Brewer signed into law today as cruel, dangerous, and hostile to women—likely to deter many Arizona women from seeking an abortion, and to distress those who nonetheless go through with one.

Life starts earliest in Arizona, which now defines gestational age as beginning on the first day of a woman’s last period, rather than at fertilization. In practice, that means the state has banned abortions after about 18 weeks (20 weeks from the last menstruation) except in the case of medical emergencies. While that provision has been much discussed, abortions after that point account for only about 1 percent of the procedures currently performed.

Hold Men’s Sperm Accountable

In response to the patriarchal treatment of our bodies as property, criminal defense attorney Ms. Karen Suzanne Wilkes has drafted sample legislation based upon licensing & property laws, demanding that men pay for “licensing, use and maintenance of our bodies & the offspring we create.”

Ms. Wilkes’ sample legislation reads:

It shall be unlawful (a felony, punishable by 10 years imprisonment) for any man to impregnate a woman without first obtaining and filing with the clerk of court a sworn affidavit signed by said woman, and signed by 2 witnesses, giving her express consent to be impregnated by that man. In addition, at the time of filing said affidavit, the man shall post a cash bond with the court in an amount equal to 20% of the man’s gross income for the next 18 years, thereby covering the cost of child support in the event a child is born as a result of the man’s act in impregnating the woman. The cash bond will also include an additional amount to cover the cost of all prenatal care & the cost of delivering the baby.

This legislation fairly shares both the burden of pregnancy and the burden of birth control and would put a swift stop to criminalizing abortion and miscarriage, as well as ceasing efforts to defund Planned Parenthood and make birth control harder to get and more expensive.

The Constitution protects property, and aren’t our bodies our property? I posited this thought to Ms. Wilkes, and she agreed, “Property is a fundamental right protected by the Constitution and cannot be taken or infringed by the State without due process of law. I think it’s fair to say that the government is infringing on a woman’s property (her body) without due process of law by forcing her to undergo (AND PAY FOR) unwanted medical procedures … not mention forcing her to carry a child & give birth against her will.”

Does it seem outrageous? Ms. Wilkes notes, “As a criminal defense lawyer and defender of freedom, liberty, the Constitution and human rights, I’m no fan of criminalizing personal activities…. However, I sure would like to counter these oppressive anti-women laws with one that puts the onus on men, just as the article suggests.”

Ms. Wilkes is referencing an article written this morning by fellow PoliticusUSA writer Hrafnkell Haraldsson. He wrote, “It is not a big step from suddenly having to treat your dog like an equal to surreal the comments of Republican State Rep. Alan Dick that women should be required to have a permission slip from the sperm’s owner before they can abort the results of its implantation. Speaking of a piece of Alaska legislation Rep. Dick (what an appropriate name) said, ‘If I thought that the man’s signature was required… required, in order for a woman to have an abortion, I’d have a little more peace about it.’”

How is this proposed legislation any more outrageous than punishing a woman for not wanting to get pregnant, getting pregnant via rape or incest, or for getting pregnant when she wasn’t ready to have a baby? It’s not. The only reason it may appear outrageous is because it inserts the government over a man’s sperm; it regulates the sperm just as they are regulating the uterus.

They are also inserting the government up our vaginal canals – literally, with state mandated transvaginal ultrasounds. They have hence already lost any government intrusion argument they might make in defense of their right over their own sperm and actions of their penis.

And I particularly like the bit about the 20% of wages for child support, because it demonstrates how smart people can use the war on women to turn the argument around and address an issue that has long needed addressing.

What can you do? Well, for starters, you can submit this suggested legislation to your state representatives. And remember, the Right is waging its war on women on the state level even more than the federal level, after discovering that it’s much harder to get their way on the federal level. You can use this knowledge to fight back on a state level.

You can send this to your state representatives and write letters to the editor in favor of it.

This is how you reframe the debate around the Constitutionality of using government to infringe upon our bodies/property. And hey, if they go for it, millions of children will finally be financially provided for by the owner of the sperm that created them and men will be forced to take responsibility for birth control.

Never just fight back against a bad argument; always reframe it by asking for something more — something that puts the burden on the other party to defend the legal premise of their own argument with something at stake for them.

It’s really the free market at work if you think about it. If we are property to be regulated and used because we can make a baby, then so is sperm. Make them pay equally for their belief and see how well that goes over.

A Personhood Amendment, for Ladies

Shaker ma_am recently suggested, in response to the onslaught of anti-choice legislation that includes encroachments on reproductive rights that undermine the autonomy of women and other people with uteri as well as proposed “Personhood Amendments” to confer personhood on fetuses, that we need a Personhood Amendment for women and other people with uteri to establish our rights as autonomous people. I suggested we compose the amendment, and then try to get a clever Democratic Senator to introduce it into the US Senate.

So we did!

And then we composed a petition, and ma_am launched it at Change.org.

Here is our prosed Personhood Amendment:

A person identifying as a woman and/or having a uterus shall retain all of the full, basic, and fundamental rights of a US citizen as guaranteed by the Declaration of Independence—life, liberty, and the pursuit of happiness. Congress and the States shall make no law that infringes upon a person’s life, including but not limited to access to life-saving or life-improving healthcare, and/or medicines and procedures deemed necessary or beneficial by a medical professional and/or by the person having the uterus, procurement of which shall not by denied in and of itself by the presence of a uterus. Congress and the States shall make no law that infringes upon a person’s liberty, including but not limited to autonomy over hir own body and the ability to make decisions regarding hir own healthcare. Congress and the States shall make no law that interferes with a person’s pursuit of happiness, including but not limited to access to a full spectrum of reproductive options, freedom from forcible reproduction, and the ability to make decisions regarding family planning and family resources.

Please sign the petition in support of the Personhood Amendment here. Once it has 1,000 signatures, it will be delivered to Senators Patty Murray (WA), Al Franken (MN), and Kristen Gillibrand (NY) with a request to introduce the proposed amendment into the legislative session.

And please spread the word about the petition via social networking sites. Let’s change this conversation. It’s time to change “women’s rights are human rights” from a radical statement to settled fact.

The vending machine at Shippensburg University’s Etter Health Center provides the Plan B emergency contraceptive along with condoms, decongestants and pregnancy tests.

Male Domination Persists as a Pervasive Reality in the U.S. and Abroad

The late poet Adrienne Rich made her life’s goal ‘the creation of a society without domination,’ but as everything from the Trayvon Martin case to the latest twist in the DSK saga shows, we have a long way to go to achieve that dream.

When the feminist poet Adrienne Rich died this week, the obituary of one of the most influential female writers of the last half-century described the goal of her life and her work as “the creation of a society without domination.”

BULLIES WITH BADGES

The rest of the week’s news illustrated how far we have to go in achieving such a dream.   In Florida, when newly-released video showed that George Zimmerman was apparently unscathed after shooting Trayvon Martin despite his claim of being injured while defending himself against attack, the message was clear: whether their authority derives from a gun or the color of their skin, men will defend their right to control people they have traditionally dominated, even if they have to kill them in cold blood.

On the video, Zimmerman’s casual ease with the police who failed to arrest him conveyed an equally brutal message: when the effort to maintain domination ends in the murder of a youth armed only with a bag of Skittles, those in power will protect their own kind instead of holding them accountable.

In New York, when a jury proved unable to reach a guilty verdict on rape charges against a drunken cop who committed a brutal sexual attack on a young woman while threatening to shoot her in the face if she cried out or opened her eyes, a comparable message was clear: men with badges and guns have the right to take what they want from women, no matter what the circumstances.

And when it turned out that Michael Pena’s trial resulted in a hung jury on rape charges because a former legal advisor to ex-Gov. Eliot Spitzer refused to convict the disgraced cop on those counts, the message from New York echoed the one emanating from Florida: men in power will band together to protect other men from being held accountable for the most heinous crimes against members of a group they have traditionally dominated–even if it’s a whole gender that represents the larger half of  humanity.

Nor will men accustomed to domination suffer even the most trivial pangs of conscience about perpetuating their protection racket, judging by the parting shot of Lloyd Constantine, who reportedly led the resistance that deadlocked the Pena jury. The verdict made the victim collapse in gasping sobs, doubled over and shaking—but Constantine said breezily, “I have not lost any sleep over this.”

His connection with Spitzer–who was driven from office for privately purchasing the bodies of female human beings for his own sexual gratification, even as he publicly led the drive to prosecute such crimes–seemed particularly creepy during a week that also included news about efforts to prosecute Dominique Strauss-Kahn on prostitution charges.

In France, DSK was reported to have helped arrange orgies with prostitutes via emails that referred to the women as “luggage,” “gifts,” and “equipment.” It’s hard to imagine a clearer example of men viewing women as less than human; in his emails setting up what he advertised as “great, sexy” gatherings, DSK objectified women’s utility as sexual receptacles the same way he might objectify any other physical thing to be used for his convenience—just as he was accused of having done in his alleged sexual assault on a hotel maid in Manhattan last year.

And back in New York, DSK’s lawyers tried this week to block a civil lawsuit by the maid on the grounds that the former head of the International Monetary Fund is protected by diplomatic immunity–one of the most abused protection rackets around, as criminal justice authorities charged with the dismal job of policing official foreign emissaries wearily attest.

Yes, things are worse elsewhere. The week’s reports from Afghanistan included news about a woman who was jailed for the crime of running away from an abusive husband, another who was jailed after being kidnapped and seeking protection from the police, a third woman who was jailed after being drugged and forced into prostitution, and yet another woman jailed after falling in love and eloping with the man of her choice.

But if you’re female, you don’t have to live in Afghanistan to get the same message enforced with such brutality in that barbarically misogynist society: Men have the right to decide what is done with the bodies of women, and women have no right to self-determination.

In the United States, the ongoing controversies over women’s access to contraception and anti-abortion legislation mandating invasive procedures like unwanted trans-vaginal probes involve the same issues as those invoked by the Taliban: who dominates whom?

White men in positions of power continue to use guns and badges, political clout and old-boy networks to maintain their dominance

Here as in Afghanistan, the answer for women continues to be men — and if you’re a black American, it’s white men. This week’s news also produced chilling reports about the effectiveness of Republican efforts to limit voter registration among minorities and other groups that tend to vote Democratic in the crucial swing state of Florida.

In the deadly battle to maintain their domination, American men admittedly have fewer tools than they used to; women and blacks are no longer considered to be property under the law, and they have the right to vote–if they can manage to overcome the onerous burdens still being imposed in the deliberate attempt to prevent them from doing so.

But even as disenfranchised groups struggle for self-determination, white men in positions of power continue to use guns and badges, political clout and old-boy networks to maintain their dominance and protect each other from being held accountable for their crimes, no matter how horrific.

Adrienne Rich’s dream helped serve as her epitaph, but the battle to end domination and assert the right of every human being to control his or her own destiny continues.

Female Circumcision: Man Myths and Mutilation

The word circumcise is defined as ‘the cutting off of the prepuce or clitoris’. This age-old practice of mutilating the genitals was originally thought to be a religious rite, but nothing could be further from the truth. The history of both male and female circumcision can be traced as far back as the early 1800’s. As myths and scant documentation would have it, the procedure was performed on boys as a symbol of the covenant between the Jews and God. Another tale from the past is one of a young boy that came to the doctor, pale and wan, with severe infections for his foreskin had become so constraining that it actually had strangled his penis by cutting off the blood flow. From this point on, male circumcision has evolved into a minor medical procedure to promote cleanliness. In today’s global society, male circumcision has become an elective procedure.

Female circumcision, however, is not the equivalent of male circumcision in terms of its short and long-term effects. To begin with it is much more brutal. It is a forceful and non-elective procedure for an entirely different reason than to ‘promote cleanliness. ‘ And sadly for these women and girls, the ability to experience orgasm may be permanently affected, particularly in cases when the clitoris is completely removed, as it is in most cases. For this reason, it’s questionable whether the term circumcision is even appropriate; mutilation is a more apt description.

Is it just me, or do we seem to be having a lot of wars lately?

I mean just in the general sense.

It seems you can’t turn around nowadays without running into another charge of the right brigade.

Now we Americans, we love war. We do, don’t we? Right from the birth of the nation, Americans have loved war the way Brazilians love soccer. We love war the way Canadians love beer and the English love misery and Australians love sheep. We love war the way the Japanese love a little girl in a sailor suit. Sure, war, that’s our thing and we’ll die with our boots on, you bet.

To paraphrase the late great George Carlin, we’re not much good anything else these days, but war, that we can do. From twelve O’clock high to the darkest hour, it’s our great escape.

We have a major one every twenty years or so. And a couple of minor ones in between.

Heat of battle, cold war, police actions, bush wars and brushfire wars, from Algiers to Zulu and a dirty dozen in between, we love ‘em all. If it’s war and peace, we’re not stopping midway we’re going for the glory.

And when we’re not at war elsewhere, well, we declare war at home just to stay in practice.

War on drugs, war on terror, war on poverty, war on guns, war on religion, war on science, war on Christmas, war on business, war on obesity, war on illegal immigration, war on saggy pants, war on crime, war on music, war on Wall Street, war on socialism, war on freedom, war on education, war on the homeless, war on this and war on that.

Hell, we once fought a war to end war, and we won!

We just love war, we Americans. That’s why so many Americans drive Hummers and carry guns, we’re always looking for some war. We don’t always need thirty seconds over Tokyo, but a quick skirmish in the Wal-Mart parking lot or a running fire fight on the I-5 would do nicely, anything to stay in practice for the next big one.

We’re open to suggestions, you just tell us what you want blown up and we’ll have the B-52s commence carpet bombing at dawn.

At the moment, seems we’re in the midst of a war on women with new fronts opening every day. Frankly, I can’t get excited about this conflict. Sooner or later, I’m probably going to get court martialed. See, I’m far too inclined to fraternize with the enemy. Listen, you guys stay here and guard the tree-fort, I’ll go over to the enemy lines and see if I can negotiate a cease fire. Soldier, hand me that bottle of wine. If I’m not back by dawn, send room service and remember the fighting 69th!

The Body Politic: This campaign needs more women and less gynecology

Actual women—instead of phony gynecological issues—pervaded the last election. Hillary Clinton, Sarah Palin, Elizabeth Edwards, Michelle Obama, Katie Couric and even Tina Fey can each credibly be said to have changed the outcome of the 2008 presidential election, as Rebecca Traister documented in her rollicking chronicle of that race, Big Girls Don’t Cry: The Election That Changed Everything for American Women.
And those were just the women at the podiums. In Traister’s account, each campaign hired women aplenty on the understanding that they could help their candidates, in one way or another, to attract voters. Got that? Women didn’t come around to discuss obscure lady matters, but to help campaigns win votes.
Yet this time around, genuine women have disappeared, in favor of sex talk smuggled under the rubric of “values.” The conversation recalls nothing so much as the days when the nightly news shows couldn’t stop running pseudo-health segments that featured male reporters fondling silicon breast implants. They’d cluck over their hazards and fondle away at the translucent synthetic protoplasms. Today’s fondlers of ultrasound wands seem no less prurient.
It’s time we sidelined the fine points of obstetrics from public discourse in an election year. Just as girlie magazines are marketed to male readers, public discourse that features women’s body parts should be clearly labeled—as Playboy used to be—”Entertainment for Men.”
Transvaginal probes? Entertainment for Men. Interstate abortions? Entertainment for Men.

Single-sex entertainment is just fine, as far as it goes. But “transvaginal” anything and “interstate abortions”—no matter what side you’re on—don’t count as social issues. This stuff is arcana, and the rhetoric associated with these topics is third-order porn, and an occasion for (mostly) male commentators, politicians and satirists—and I mean you lefties too, Jon Stewart and Garry Trudeau!—to perseverate on gynecology in a weird O.C.D. way.
It’s creepy.
Really, the zeal with which male politicians of all stripes make politics sexual is disconcerting. Last week Barack Obama placed a personal call to console Sandra Fluke, asking the law student and advocate of birth-control subsidies if she were “OK” in the days since Rush Limbaugh incoherently deemed her platform akin to sexual promiscuity. Limbaugh had likened Fluke to people who are paid for sex, and likened taxpayers to her pimps, or some bunk like that; Obama aimed to redeem a 30-year-old woman by comparing her to his daughters, ages 10 and 13, who evidently need his protection from bad men who use bad words.

Great Moments in Not Knowing Shit About Birth Control

It’s been a roller coaster ride of a year for women and their ladyparts, thanks in large part to people who know nothing about birth control trying to discuss the nuances of birth control. Here’s a loving homage to those misguided blabbermouths muddying up the national conversation with confidently delivered misconceptions.
Falsehoods about what birth control is, and what the birth control mandate does, are so rampant that they’ve been given a place in the debate alongside actual facts. Bill O’Reilly seems to think that there are “thousands” of federally funded health care providers who distribute free birth control to anyone who just waltzes on in, Santorum funder Foster Freiss thinks that simply not having sex will do all of the things that birth control does, Fox News pundit Greg Gutfeld thinks that giving everyone access to low-cost birth control is the same thing as hating poor people, Sean Hannity thinks all birth control costs like $9 per month, regardless of the prescription, and another Fox anchor seems to think that condoms should do just fine for every woman, no matter what her situation or preferences. O’Reilly tells his viewers that compelling insurers to let female employees who pay premiums use their premiums to purchase birth control is akin to forcing Bill O’Reilly to personally buy Depo Provera injections for every Tri-Delt in America. None of these things are remotely facty.

Not every Great Moment could be included in this montage. Virginia Delegate Dave Albo’s story about how all this talk of “trans-v” ultrasounds led his wife to deny him conjugal access to her “v” didn’t make the cut, even though he was trying to legislate vaginas, a body part he couldn’t even bring himself to pronounce. The all-male House panel testifying to a nearly all-male House committee about how giving women access to birth control through plans sponsored by employers violated their freedom of religion (which apparently is also “freedom of oppression”) didn’t make the cut, either, because I couldn’t bring myself to watch that whole thing again. And of course, there are hours and hours of footage of Bill O’Reilly inching himself closer and closer to an insurance-funded quadruple bypass.
